Terms and conditions

Your use of the Wunderman e-newsletter, any Wunderman blog and any Wunderman website (collectively the 'Services', individually a 'Service') is governed by these terms and conditions. By accessing the Services you agree to be bound by these terms and conditions ('terms'). We recommend that you read the terms carefully. Please note that if you do not agree to be bound by these terms you should not access, view or use the Services.

The information contained in the Services is intended for general information purposes only. Wunderman has made all reasonable efforts to ensure that the information contained in the Services is accurate at the time of inclusion, however there may be inaccuracies and occasional errors for which Wunderman apologises.

The information, images and materials contained within the Services are owned by or licensed to Wunderman. Wunderman permits you to make copies of the Services as necessary incidental acts during your viewing or proper use of the Services; and you may take a print for your personal use of so much of the site as is reasonable for private purposes. However, you may not frame any Wunderman website nor link to a page other than the home page without our express permission in writing.

'Wunderman' and the other tradenames, marks, designs and logos used by Wunderman are trademarks of and owned by Wunderman and/or its parent company WPP Group plc. Except as specifically permitted in accordance with these terms, any use of such trademarks, tradenames, marks, designs and logos is strictly prohibited. In addition, the names, tradenames and/or trademarks of third parties, including clients of Wunderman, may appear in content accessible by the Services from time to time. All such names, tradenames and trademarks are proprietary to their respective owners and may be used only with the express written permission of their respective owners.

From time to time, you might be able to make contributions to the Services, e.g. by responding to our blogs.

Please remember that the contributions you make will be viewable by other users and therefore by making contributions you agree that:

• Your contribution is your own original work and does not infringe the rights of any third party;
• Your contribution does not contain or refer to any third party trade names or marks;
• Your contribution does not contain any obscene, sexually explicit, violent, offensive, inflammatory, defamatory or otherwise inappropriate or morally offensive information and material (as solely determined by Wunderman);
• Your submission will be in keeping with the intended spirit of the Services, meaning that you will be respectful to others and will not post spoilers, be off-topic, impersonate others, post advertising or commercial material or otherwise act in an unreasonable manner;
• You grant to Wunderman and any successor in title a perpetual, irrevocable, non-exclusive, worldwide, royalty-free licence to display your contribution in connection with the Services;
• You hereby waive in favour of Wunderman and any successor in title all so-called ‘moral rights' or similar rights now existing or created in the future in any part of the world in respect of your contribution;
• Where you are in breach of any of these terms or any third party rights, you agree to be fully responsible for any liability suffered by Wunderman, its licensors, contractors, employees, directors, consultants or agents in relation to that breach.

Wunderman does not permit infringement of other parties' intellectual property rights. If you believe that any content contained in any of the Services infringes a third party's legal rights, please notify us by email to info@wunderman.com including sufficient information and details to enable us to identify the content. Wunderman may suspend or disable access to any content or user contribution without notice and at our sole discretion. Wunderman reserves the right to reject complaints at our sole discretion.

You shall not use the Services for any illegal purposes and in particular you agree that you shall not send, use, copy, post or allow any posting which is defamatory or obscene within the meaning of the Obscene Publications Act or which is abusive, indecent or in breach of the privacy of any person. You agree not to send any unsolicited promotional or advertising material, spam or similar materials or any volume messages that may interfere with the operation of any of the Services or with the enjoyment of the Services by other visitors or users.

If you are in breach of these terms or of Wunderman's Privacy Policy Wunderman may, at our option, suspend or block your access to the Services and refuse to provide you with any further access to it.

You hereby agree to indemnify Wunderman against any costs, claims, losses and damages (including legal fees) incurred by or awarded against Wunderman as a result of your misuse of any of the Services or your breach of these terms.

The Services are provided to you free of charge, and neither Wunderman nor any of its parent, subsidiary or affiliated companies accept any liability to you (except in the case of personal injury or death caused by its negligence or for fraud or as required by law) whether in contract, tort (including negligence) or otherwise, arising out of it in connection with the Services. Wunderman accepts no liability for any direct, special, indirect or consequential damages, or any other damages of whatsoever kind resulting from whatever cause through the use of any information obtained either directly or indirectly from the Services. Your sole remedy is to discontinue using the Services.

Wunderman makes no representations or warranties about the information provided through the Services, including any hypertext links to any website or other items used either directly or indirectly from any of the Services. The information and materials provided by the Services is provided on an 'AS IS' basis. Accordingly, Wunderman accepts no liability for any inaccuracies or omissions contained in any of the Services and any decisions based on information contained in the Services are the sole responsibility of the user of the Services. Wunderman cannot vouch for the content, information and materials contained in any third party's website.

In particular, please note that any content submitted by third parties contained in the Services (e.g. blog responses) are solely the opinions and responsibility of the person or entity named as the author and do not necessarily reflect the opinions of Wunderman. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials.

While Wunderman takes care when creating the Services, we cannot and do not guarantee that the Services will be free from any viruses and/or other code that may have contaminating or destructive elements. Wunderman will not be liable for any loss or damage caused by distributed viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Services. Your use of the Services is at your sole risk.

These terms may be amended by Wunderman from time to time without notice, so you should check the terms for any changes when you use the Services.

In the event that any or any part of the terms shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms which shall continue to be valid and enforceable to the fullest extent permitted by law.

Your use of the Services and downloads from it, and the operation of these terms, shall be governed in accordance with the laws of England and Wales. The English courts shall have exclusive jurisdiction over any dispute arising out of your use of this website.

References to 'Wunderman', 'we', 'us' and 'our' are references to Wunderman.
